Legal precedent only carries weight if it conforms to constitutional authority. A system built on political party control of presidential elections was never authorized by the Constitution—so no amount of time, tradition, or repetition grants it constitutional legitimacy.
Marbury v. Madison (1803) - “An act repugnant to the Constitution is void.”
